This Privacy Policy describes how we collect, use, process, store, disclose, and protect information when you use our websites, QR-code registration pages, event photography services, photo booth services, photo-delivery services, applications, software-enabled photography experiences, text-message delivery services, and related products and services (collectively, the “Services”).

Our Services may use technology and software licensed, supplied, hosted, or otherwise made available in conjunction with Simply Human AI Holdings, LLC and other technology service providers.

By accessing or using the Services, you acknowledge the practices described in this Privacy Policy.

1. WHO WE ARE

Fate Studios Creative provides photography, event photography, headshot, photo booth, image-processing, image-matching, and digital photo-delivery services for weddings, corporate events, private events, and other experiences.

Guests may be invited to scan a QR code or visit a web page, provide certain information, consent to photography and processing, and receive photographs associated with them through text message or another digital delivery method.

2. INFORMATION WE MAY COLLECT

Depending upon how you interact with our Services, we may collect the following categories of information.

  • Uploaded reference images or selfies, if the applicable experience permits them; and
  • Other images created as part of the event.

A photograph may constitute personal information when it identifies, relates to, describes, or can reasonably be associated with a particular individual.

C. Facial and Image-Matching Information

Certain versions of our Services may use automated image-analysis, artificial-intelligence, computer-vision, or facial-similarity technology to assist in identifying photographs that are likely to depict an opted-in guest.

Where enabled, the technology may analyze characteristics of an image or face for the limited purpose of finding and delivering photographs associated with the participating individual.

If our technology creates, stores, or processes a biometric identifier, biometric template, facial geometry, face embedding, or similar information capable of being used to uniquely identify an individual, we will treat that information as sensitive information and apply additional protections required by applicable law.

We do not sell biometric identifiers or biometric templates.

Unless separately disclosed to you and consented to where required by law, we do not use facial-analysis information to determine sensitive characteristics such as race, ethnicity, religion, health status, sexual orientation, political beliefs, or similar personal characteristics.

D. Device and Website Information

When you use our websites or QR registration pages, we or our service providers may automatically receive information including:

  • IP address;
  • Browser type;
  • Device type;
  • Operating system;
  • Referring page;
  • Pages viewed;
  • Date and time of access;
  • Cookie or similar identifiers;
  • Approximate location derived from IP address; and
  • Website diagnostic, security, and performance information.

3. HOW WE USE INFORMATION

We may use personal information to:

  • Register guests for an event photography experience;
  • Record and document consent;
  • Photograph participating guests;
  • Associate photographs with participating guests;
  • Process and organize photographs;
  • Identify or suggest photographs that may depict a participant;
  • Deliver photographs to a participant's mobile device;
  • Send transactional or service-related text messages;
  • Provide customer support;
  • Respond to privacy requests;
  • Prevent fraud, abuse, or unauthorized access;

We will not use consent provided solely for event photo delivery as authorization for unrelated marketing where separate consent is legally required.

4. TEXT MESSAGE PHOTO DELIVERY

If you voluntarily provide a mobile telephone number and request photo delivery, you authorize Fate Studios and service providers acting on our behalf to send service-related text messages to the number you provide.

These messages may include:

  • Registration confirmations;
  • Verification messages;
  • Links to photographs;
  • Notifications that photographs are available;
  • Event-photo updates;
  • Security or account-related notices; and
  • Customer-service communications related to your requested photo experience.

Message frequency varies.

Message and data rates may apply.

Consent to receive marketing messages is not a condition of purchasing goods or services.

Where applicable, you may reply STOP to discontinue text messages and HELP for assistance.

Stopping text messages may prevent us from delivering additional photographs through SMS.

Transactional communications necessary to fulfill an existing request may be treated differently from promotional or marketing communications as permitted by applicable law.

5. PHOTOGRAPHY AT EVENTS

Events may contain both participating and non-participating guests.

Scanning a QR code and completing registration indicates that you affirmatively wish to participate in the applicable photo-delivery experience.

Because weddings, conferences, and other events occur in shared physical spaces, a photograph of a participating individual may incidentally include other people.

We may also be independently engaged by the wedding couple, company, event organizer, venue, sponsor, or other client to photograph the event. Photography performed under that separate engagement may be governed by additional agreements between Fate Studios and the applicable client.

6. HOW WE DISCLOSE INFORMATION

We may disclose personal information to service providers and contractors that perform services on our behalf, including providers of:

  • Software infrastructure;
  • Artificial-intelligence or image-processing technology;
  • Cloud storage;
  • Website hosting;
  • SMS/text-message delivery;
  • Telecommunications;
  • Content delivery;
  • Database management;
  • Cybersecurity;
  • Analytics;
  • Customer support; and
  • Professional legal, accounting, insurance, or compliance services.

Technology used in providing the Services may be licensed, supplied, developed, or supported in conjunction with Simply Human AI Holdings, LLC.

Such entities may process information as necessary to provide technology or services to us, subject to applicable contractual and legal restrictions.

We may also disclose information when reasonably necessary to:

  • Comply with law, regulation, subpoena, court order, or lawful governmental request;
  • Investigate fraud or security incidents;
  • Protect the rights, property, safety, or security of Fate Studios, our customers, participants, or others;

7. SALE AND SHARING OF PERSONAL INFORMATION

Fate Studios does not sell your photographs, mobile telephone number, or biometric identifiers for monetary consideration.

We do not knowingly sell personal information belonging to children.

If our business practices in the future constitute a “sale” or “sharing” of personal information as those terms are defined under applicable privacy law, we will provide legally required notices and choices before or at the time required by law.

8. ADVERTISING AND FACIAL IMAGES

Participation in an event photo-delivery experience does not, by itself, constitute consent for Fate Studios to use your identifiable likeness in paid advertising, commercial endorsements, or unrelated promotional campaigns.

Where we wish to use an identifiable participant's photograph for a use requiring additional authorization, we may obtain a separate model release, photography release, event agreement, or other authorization.

This limitation does not restrict uses otherwise permitted by law or by a separate agreement applicable to the event.

9. DATA RETENTION

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, including providing the Services, delivering photographs, maintaining necessary business records, complying with law, resolving disputes, preventing fraud, and enforcing agreements.

Different categories of information may have different retention periods.

Where facial-analysis data, face embeddings, biometric templates, or comparable technical data are created solely for photo matching, we seek to retain such information only for the period reasonably necessary to provide the applicable service, unless a longer retention period is required or permitted by law or separately authorized.

Backups may persist for a limited additional period until overwritten or deleted through ordinary backup cycles.

We may retain records demonstrating consent, opt-outs, transactions, legal compliance, and privacy requests for longer periods when reasonably necessary to establish compliance or protect legal rights.

10. SECURITY

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure.

However, no electronic storage, telecommunications network, website, cloud platform, or data-transmission method can be guaranteed to be completely secure.

Accordingly, we cannot guarantee absolute security.

11. ACCURACY OF IMAGE MATCHING

Automated image-matching technology is not perfect.

A photograph may be incorrectly associated with a participant, and the system may fail to locate photographs that actually depict a participant.

12. YOUR PRIVACY CHOICES

Depending on where you reside and applicable law, you may have the right to request that we:

  • Confirm whether we process your personal information;
  • Provide access to certain personal information;
  • Correct inaccurate personal information;
  • Delete certain personal information;
  • Provide information regarding categories of information collected or disclosed;
  • Limit certain uses of sensitive personal information;
  • Opt you out of certain sales, sharing, or targeted advertising;
  • Provide a portable copy of certain information; or

Where legally required, we will honor authorized-agent requests after completing required verification procedures.

14. CHILDREN

Our Services are intended for a general audience and are not directed to children under 13.

Individuals under 13 should not independently register for the Services or submit a telephone number, photograph, selfie, or other personal information.

If participation by a child under 13 is permitted at an event, the child's parent or legal guardian must complete any legally required consent process on the child's behalf before we knowingly collect personal information from that child.

If we learn that we collected personal information online directly from a child under 13 without legally sufficient parental consent, we will take appropriate steps to delete or otherwise handle the information as required by applicable law.

15. THIRD-PARTY SERVICES

Our Services may rely on third-party technology platforms.

Those providers may process information on our behalf or, in limited circumstances, under their own applicable terms and privacy policies.

We are not responsible for independent websites, applications, or services that are not controlled by Fate Studios.

16. EVENT ORGANIZERS

Fate Studios may provide Services on behalf of wedding couples, corporations, conference organizers, venues, sponsors, agencies, or other event customers.

In some circumstances, the event organizer and Fate Studios may separately determine how certain information is collected or used.

Questions regarding an event organizer's independent use of your information should be directed to that organizer.

17. INTERNATIONAL PROCESSING

Our technology providers may process information from locations other than the location where the information was originally collected.

Where required, we take reasonable measures designed to provide appropriate protections for such transfers.

18. DO NOT TRACK

Because there is not a universally accepted standard for responding to browser-based “Do Not Track” signals, our Services may not respond to all such signals.

Where applicable law requires recognition of a legally valid universal opt-out preference signal, we will process supported signals as required by law.
